Montana Lawmakers Propose 15% THC Cap and Cannabis Tax Fund Changes

A Senate committee is reviewing two bills that could significantly impact Montana’s cannabis industry. Senate Bill 443, sponsored by Sen. Greg Hertz, would cap THC potency in non-medical marijuana products at 15%, a drastic reduction from the current 35% THC limit on flower. Proponents of the bill cite concerns about the health effects of high-potency cannabis, particularly among young people, while opponents warn that the change could force consumers toward the illicit market and devastate the legal industry.

Meanwhile, Senate Bill 307, introduced by Sen. Tom McGillvray, proposes redirecting cannabis tax revenue away from outdoor conservation programs, veterans' services, and the Montana Board of Crime Control. Instead, funds would be allocated to addiction recovery initiatives and the state’s general fund. The proposal has drawn mixed reactions, with some supporting investment in treatment programs while others argue that conservation funding should remain intact.
